Order Policy



Halestorm sells all of its products on this website for ornamental purposes only.  By ordering any of Halestorm’s products, you agree to use the products only for ornamental purposes.  Any other use of Halestorm’s products is a material breach of these terms and conditions.  


You agree to assume all risks, responsibilities, and liabilities associated with any unauthorized use of the products purchased from this website.  Products purchased from this website are intended only for ornamental uses and not for consumption.  In no event will Halestorm be responsible or liable for any damages or injuries caused by or associated with the unauthorized use of the products on this website.


Halestorm reserves the right to refuse to accept orders and deny website access to any user who does not agree to these terms and conditions, has breached the terms and conditions, or expressed an intent to breach the terms and conditions, as determined by Halestorm in its sole discretion.  


The products available for purchase on this website do not constitute offers by Halestorm to sell them.  Upon placing your order, Halestorm has the right to accept or decline your order for any reason or supply less than the quantity you ordered of any item, in its sole discretion.  You will only be charged for the products shipped.  Halestorm’s confirmation of your order sent electronically, or in any other form, does not constitute acceptance of your offer to purchase.



 Credit Cards



We accept the following credit cards: Visa, MasterCard, and AMEX.  There is no surcharge for using your credit card to make purchases.  When making a purchase, please provide your exact billing address and telephone number (i.e. the address and phone number your credit card bank has on file for you).  Incorrect information will cause a delay in processing your order.  Your credit card will be billed upon shipment of your order.

Returns


We will accept the return of any dried products that are damaged and cannot be used for ornamental purposes, if returned within 30 days from the date of purchase.  We will issue a full refund upon receipt of the returned products.


If we mistakenly ship you the incorrect product, we will accept the return of that product, if returned within 30 days from the date of purchase.  We will issue a full refund upon receipt of the returned, undamaged products.  If you return the product damaged, leaving us unable to restock and sell the product, you will not receive a refund.


Taxes


Halestorm shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within the same state.  For orders shipped to other states, you are solely responsible for all sales taxes or other taxes.

  


Pricing Errors


In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, Halestorm shall have the right to refuse or cancel any orders placed for products listed at the incorrect price, whether or not the order has been confirmed and before your credit card has been charged.

Halestorm keeps your personal information private and secure. When you place an order from this website, you provide your name, email address, credit card information, address, phone number, and a password. Halestorm uses this information to process your orders, to keep you updated on your orders and to personalize your shopping experience.  This website uses "cookies" to keep track of your current shopping session to personalize your experience and so that you may retrieve your shopping cart at any time.  This website also uses secure servers that protect your information using advanced encryption techniques and firewall technology.

When entering any of this website’s contests or prize drawings, you provide your name, email address and mailing address.  If you win, we will send the prize to the address entered and notify you by email.  When you enter a contest or drawing you are also included in our newsletter list to receive notice of promotions, specials and new website additions. You may unsubscribe from this news list by following the unsubscribe instructions in any email received from Halestorm.


Forum Selection,  Choice of Law, Consent to Jurisdiction, and Waiver of Right to Jury Trial

You and Halestorm agree that, with respect to all matters involving these terms and conditions, this website, and Halestorm’s products available for purchase from this website: (1) any action brought in law or equity (“Action”) shall be filed in a state or federal court located in Phoenix, Arizona (collectively, “Court”) and that Court shall have exclusive jurisdiction over the matter, (2) you and Halestorm each consent in advance to the jurisdiction of the Court over you personally and the subject matter of any Action, (3) you and Halestorm each waive any objection that the Court is sitting in an inconvenient or improper forum, and (4) any Action shall be tried in a court of competent jurisdiction by a judge sitting without a jury.  Any Action shall be governed by Arizona law.
